In short
The information system in which the Ministry of Trade collects e-commerce data and records online sellers and marketplaces; registration is mandatory.
ETBİS (Electronic Commerce Information System) is the information system established by the Ministry of Trade to collect and process e-commerce data and to record sellers and marketplaces. It was first set up by a communiqué and added to Law No. 6563 in 2022.
Who Must Register?
- Sellers selling through their own website or mobile app,
- Sellers selling on marketplaces,
- Marketplaces and other intermediary service providers.
What Is Reported?
On registration, identity and contact details, the e-commerce environments used (domain names, apps), areas of activity and payment and delivery services used are reported. Marketplaces also periodically report data on their sellers and transactions. The registration must be updated when details change.
Why ETBİS Matters
- Net transaction volume: The net transaction volume of sellers and marketplaces is calculated from ETBİS records; this determines licensing and scale-based obligations.
- Trade mark protection: Sellers may not advertise on search engines using registered trade marks recorded in ETBİS without permission; trade mark owners therefore benefit from registering their marks with ETBİS.
- Supervision: Ministry of Trade inspections are based on ETBİS records; failing to register or incomplete reporting may lead to administrative fines.
