Author Ali GülUpdated
Who is this for, and when?
- Who it is for: Marketing, CRM, legal and compliance teams of companies marketing by SMS, e-mail or phone in Turkey; agencies and messaging providers sending on their behalf.
- When: When designing a campaign, before sending to a new database and when a complaint letter arrives from the Ministry of Trade.
Commercial electronic messages, meaning SMS, e-mails, calls and similar messages sent to promote goods and services, are governed by Law No. 6563 on the Regulation of Electronic Commerce. Article 12 of the Law sets administrative fines with minimum and maximum limits. The amounts are increased each year by the revaluation rate and announced by the Ministry of Trade in a communiqué. The 2026 amounts were set on the basis of a 25.49% rate by the Communiqué published in the Official Gazette of 25 December 2025 and apply from 1 January to 31 December 2026.
Commercial Electronic Message Fines for 2026
| Breach | Legal basis | Minimum | Maximum |
|---|---|---|---|
| Sending a message without the recipient’s prior consent; content not matching the consent given | Art. 12(1)(a) (Arts. 6(1), 7(1)) | TRY 2,859 | TRY 14,309 |
| Failing to identify the sender, give contact details or state the subject and purpose of the message | Art. 12(1)(b) (Arts. 7(2)–(3)) | TRY 2,859 | TRY 28,620 |
| Failing to offer an easy and free opt-out; continuing to send more than 3 business days after an opt-out | Art. 12(1)(c) (Arts. 8(2)–(3)) | TRY 5,723 | TRY 42,930 |
| Sending a message without consent to several people at once | Art. 12(2) | The fine in (a) is increased up to tenfold | TRY 143,090 |
The same provisions also cover certain information duties in e-commerce and the requirement to state promotion terms clearly. The higher fines for marketplaces and intermediary service providers are outside this table.
Rules That Increase the Fine
The amounts in the table are per breach. In practice, three rules increase the total:
- Bulk sending: If a message without consent is sent to several people at once, the fine is increased up to tenfold (Art. 12(2)).
- Repetition: If the same breach is repeated within one year of notification of the fine, or is not remedied within the period set by the Ministry, double the previous fine applies (Art. 12(4)).
- Misleading the Ministry: If the breach involves acts intended to mislead the Ministry, the fine is multiplied by ten (Art. 12(5)).
Each complaint is examined as a separate file, so a single campaign without consent can lead to several complaints and several fines.
Fines in Previous Years
The current fine system took effect on 1 January 2023 under Law No. 7416. The amounts since then:
| Year | Type | No consent (a) | Missing information (b) | Opt-out (c) | Bulk sending (a × 10) |
|---|---|---|---|---|---|
| 2026 | Minimum | 2,859 | 2,859 | 5,723 | – |
| Maximum | 14,309 | 28,620 | 42,930 | 143,090 | |
| 2025 | Minimum | 2,279 | 2,279 | 4,561 | – |
| Maximum | 11,403 | 22,807 | 34,210 | 114,030 | |
| 2024 | Minimum | 1,584 | 1,584 | 3,169 | – |
| Maximum | 7,923 | 15,846 | 23,769 | 79,230 | |
| 2023 | Minimum | 1,000 | 1,000 | 2,000 | – |
| Maximum | 5,000 | 10,000 | 15,000 | 50,000 |
Amounts are in Turkish lira. The bulk sending column shows ten times the maximum in (a). As a rule, the fine is based on the amounts for the year the message was sent.
İYS Rules: Where Most Fines Start
The Message Management System (İYS) is the central register of consents and opt-outs for commercial messages. Under the Regulation on Commercial Communication and Commercial Electronic Messages:
- Anyone who wishes to send commercial messages must register with İYS.
- Consents obtained outside İYS, for example through a web form or in store, must be recorded in İYS within 3 business days. Consents not recorded in İYS are deemed invalid.
- Commercial messages cannot be sent to recipients without consent in İYS.
- The burden of proving consent obtained outside İYS lies with the service provider.
- Opt-outs must be applied and reported to İYS within 3 business days. Recipients can also opt out directly through İYS.
- Consent records are kept for 3 years after the consent ends, and other message records for 3 years from the date of the record.
Messages that need no consent: Where a recipient has given contact details to be contacted, messages about changes to, use of or maintenance of the goods or services they obtained do not require separate consent. Informational messages such as subscription, collection and delivery notices can also be sent without consent, but adding promotional content turns them into commercial messages.
Merchants and tradespeople: Messages may be sent to merchants and tradespeople without prior consent. However, they must be recorded in İYS before sending, and their opt-out status must be checked.
Complaints and Investigation
Recipients can complain through e-Devlet, İYS or the Ministry of Trade website, or in writing to the provincial directorate. A complaint must be made within three months of the date the message was sent, and a person may only complain about messages sent to their own address. The provincial directorate asks the company for proof of consent; if consent cannot be proven, a fine is imposed. The power to fine belongs to the Ministry of Trade and is exercised in practice by its provincial directorates.
Payment, Discount and Objection
The fine must be paid within one month of notification; paying within this period earns a 25% discount. Payment does not affect the right to object.
Under Article 27 of the Misdemeanours Law, commercial message fines are challenged before the criminal judgeship of peace within 15 days of notification. If the deadline is missed, the fine becomes final. See challenging administrative fines for details.
Relationship with KVKK
The phone numbers and e-mail addresses used for commercial messages are personal data. Consent obtained under Law No. 6563 does not automatically satisfy the KVKK requirements for processing contact data for marketing. One campaign can lead both to a commercial message fine and to a KVKK investigation. For the KVKK amounts, see KVKK Administrative Fines 2026.
What Will the Amounts Be in 2027?
The 2027 amounts will be based on the revaluation rate to be announced at the end of November 2026 and will be published in a Ministry of Trade communiqué in December. This page will be updated once the communiqué is published.
