Message Management System (IYS)

Also known as: İYS, İleti Yönetim Sistemi, IYS Registration

Author

In short

The national database in which approvals and opt-outs for commercial electronic messages are recorded, with which service providers must register and through which recipients can manage their permissions.

The Message Management System (IYS) is the national database in which approvals and opt-outs for commercial electronic messages are recorded. It is operated by İleti Yönetim Sistemi A.Ş., established by the Union of Chambers and Commodity Exchanges of Turkey under the authority of the Ministry of Trade, and was made mandatory by the Regulation on Commercial Communications and Commercial Electronic Messages.

Obligations of Service Providers

  • Registration: Service providers wishing to send commercial electronic messages must register with IYS.
  • Recording approvals: Approvals obtained must be recorded in IYS. Approvals not recorded in IYS are invalid.
  • Pre-send checks: Before sending, the recipient’s permission status in IYS must be checked. No message may be sent to a recipient without an approval in IYS or who has opted out.
  • Channel-based management: Approvals are managed separately for calls, text messages and e-mail.

For Recipients

Recipients can see through the IYS website and mobile app which brands they have given permission to on which channels, withdraw permissions and opt out. Opt-outs made through IYS are passed to the service provider, and sending must stop within three business days at the latest.

Common Problems

  • Legacy databases: Sending on the basis of approvals collected before IYS and never transferred to it.
  • Agencies and bulk senders: Responsibility remaining with the service provider where the sending company does not run IYS checks.
  • In-store and call centre approvals: Approvals obtained through physical channels not being transferred to IYS on time with the correct channel information.
  • Push notifications: Although the legislation provides no exception for app notifications, the IYS infrastructure does not support this channel; obtaining approval clearly and separately within the app is therefore important.

Frequently Asked Questions

Can we send marketing e-mails without registering with IYS?

Service providers sending commercial electronic messages must register with IYS and record their approvals there. Sending a message to a recipient without an approval in IYS is treated as sending without approval.

If an agency sends the messages, who is responsible for IYS?

The company having the message sent to promote its own goods or services is responsible as the service provider. The contract with the agency should clearly state that an IYS check is carried out before sending and who is responsible for checking approvals.
