Right of Withdrawal

Also known as: Cooling-Off Period, 14-Day Return, Withdrawal Notice, Cayma Hakkı

Author

In short

The consumer's right to withdraw from a distance contract within fourteen days without giving reasons and without paying a penalty; since 2026, return costs may generally not be charged to the consumer.

The right of withdrawal is governed by Article 48 of Law No. 6502 and the Distance Contracts Regulation. In distance contracts, the consumer may withdraw within fourteen days without giving reasons and without paying a penalty.

When the Period Starts

  • Service contracts: The day the contract is concluded,
  • Sales of goods: The day the consumer or a third party designated by them receives the goods,
  • Multiple goods delivered separately under one order: The day the last item is received.

The consumer may also exercise the right between conclusion of the contract and delivery of the goods.

Procedure

  1. The consumer notifies the seller of the withdrawal decision within the period by a clear statement.
  2. The seller refunds all payments received, including delivery charges, within fourteen days of receiving the withdrawal notice.
  3. The consumer returns the goods to the seller within ten days of the notice.

Return Costs (2026 Change)

Since 1 January 2026, if the consumer returns the goods via the return carrier stated by the seller in the pre-contractual information, the consumer cannot be held liable for return costs. If the seller did not state a carrier, no return cost may be charged to the consumer. If the stated carrier has no branch where the consumer is located, the seller must arrange collection of the goods at no extra cost. Where these failures are attributable to the marketplace, the costs and obligations fall on the marketplace.

If Information Is Not Given

If the seller does not give the necessary information on withdrawal in the pre-contractual information, the consumer is not bound by the fourteen-day period; in any event the period ends one year after the end of the withdrawal period. For contracts where withdrawal is not available, see Exceptions to the Right of Withdrawal.

Frequently Asked Questions

Can we charge the consumer for return shipping?

Not since 1 January 2026. If the goods are returned via the return carrier stated in the pre-contractual information, the consumer cannot be charged; if no carrier was stated, no return cost may be charged either. If the carrier has no branch where the consumer is located, the seller must arrange collection at no extra cost.

Can the right of withdrawal be exercised if the product was used?

As a rule, yes. The consumer is liable for loss of value caused by use beyond what is necessary to establish the nature and functioning of the goods, but this does not remove the right of withdrawal. Exceptions such as opened hygiene products are assessed separately.
