Author Ali Gül
In short
The seller's obligation in distance selling to deliver within the promised period and in any event within thirty days; if not delivered on time, the consumer may terminate the contract.
Under the Distance Contracts Regulation, the seller must perform within the period it promised from receipt of the consumer’s order. For sales of goods, this period may in any event not exceed thirty days.
Non-Delivery
If the seller does not deliver on time, the consumer may terminate the contract. On termination, the seller must refund all payments, including delivery charges, within fourteen days of receiving the termination notice.
Impossibility of Performance
Where supplying the ordered goods or services becomes impossible, the seller must notify the consumer in writing or on a durable medium within three days of learning of it and refund all payments within fourteen days. Keeping out-of-stock products available for sale is therefore risky.
Showing the Delivery Period
The promised delivery period should be stated realistically in the pre-contractual information and on the product page. Failing to meet delivery promises such as “same-day shipping” or “at your door tomorrow” may also be an unfair commercial practice. Longer delivery times during busy campaign periods should be announced in advance.
Relationship with Withdrawal
For sales of goods, the delivery date starts the right of withdrawal period. The burden of proving delivery lies with the seller; tracking records and delivery receipts should be kept. For loss and damage in transit, see Delivery Liability.
