Pre-Contractual Information Obligation

Also known as: Pre-Information Form, Pre-Contractual Information Form, Ön Bilgilendirme

Author

In short

The seller's obligation, before a distance contract is concluded, to give the consumer clear and understandable information on matters such as the seller's identity, main characteristics of the product, total price, payment and delivery, the right of withdrawal and dispute resolution, and to obtain confirmation.

Pre-contractual information is governed by Article 5 of the Distance Contracts Regulation. Before concluding a distance contract or accepting any corresponding offer, the consumer must be informed clearly and understandably in a manner appropriate to the means of distance communication used.

Mandatory Information

  • The main characteristics of the goods or services,
  • The seller’s name or trade name, MERSİS number, full address, phone and other contact details,
  • The total price including taxes and additional costs such as delivery charges,
  • Payment, delivery and performance details and the promised delivery period,
  • The conditions, period and procedure for exercising the right of withdrawal and information on the carrier designated by the seller for returns,
  • Where there is no right of withdrawal, a clear statement of the exception,
  • Contact details for complaints,
  • Information that the consumer may apply to the consumer arbitration committee or to the consumer court subject to first applying to a mediator.

The return carrier and mediation information was added by the amendment effective 1 January 2026; forms prepared before that date must be updated.

Confirmation and Proof

The consumer must confirm having read and accepted the pre-contractual information; in practice this is done with a separate checkbox before the payment step. The burden of proving that pre-contractual information was given lies with the seller. On marketplaces, pre-contractual information consists of information provided jointly by the marketplace and the seller.

Consequences of Incomplete Information

Incomplete information may lead to administrative fines. If information on the right of withdrawal is not given, the consumer is not bound by the fourteen-day period; the right of withdrawal ends at the latest one year after the end of that period.

Frequently Asked Questions

What happens if pre-contractual information is incomplete?

Incomplete or incorrect information may lead to administrative fines. If information on the right of withdrawal is not given, the consumer is not bound by the fourteen-day period; it is extended by up to one year from the end of the withdrawal period.
