Prize Draws and Promotions

Promotional draws that pick winners by chance from among participants, including a giveaway on social media, generally require a permit. We structure your draws and promotional campaigns from a legal perspective, run the permit process and make sure the draw is carried out in line with the legislation.

What is a promotional draw, and why does it require a permit?

A promotional draw is a campaign organised to promote a product or brand in which prize winners are determined by chance. In Türkiye, draws require a permit from the National Lottery Administration (Milli Piyango İdaresi) even if participation is free. “Like, share, win” draws held on social media accounts also fall within this scope.

Holding a draw without a permit may lead to administrative sanctions. Besides obtaining the permit, holding the draw before a notary, announcing the participation terms in advance, delivering the prizes and paying the taxes arising on them are also part of the process.

What is the difference between a draw and a competition?

Competitions in which the winner is determined not by chance but by objective criteria such as knowledge, skill or a jury’s assessment may not be subject to the permit regime for draws. Structuring the campaign correctly on the basis of this distinction directly affects whether a permit is needed and how the process runs.

Frequently Asked Questions

Do we need a permit for a small giveaway on Instagram?

Yes. Neither the value of the prize nor free participation removes the need for a permit; promotional draws in which the winner is determined by chance require one.

When should the permit application be made?

Before the campaign is announced. When planning the campaign timetable, the time needed for the permit process and for preparing the required documents should be taken into account.

How should the results of the draw be announced?

The results must be announced in the manner and within the time set out in advance in the campaign terms. Winners' personal data must be shared in line with the KVKK, and participants must be informed about this in advance.

Who pays the tax on the prizes?

Taxes arising on draw prizes are calculated and paid by the organiser of the draw. This cost should be included in the campaign budget from the outset; the details are assessed together with a financial adviser.
